Generative Artificial Intelligence (GAI) has the potential to change the practice of law with real opportunities for growth and advancement for attorneys who knowledgeably adopt and use GAI tools. However, ignoring GAI technology or hastily rushing its implementation can create ethics and malpractice risks. (Ethics) Hour 2 (50 minutes) – The Ethics and Malpractice Risk When Lawyers Leave Law Firms – Lawyers leave law firms.  Sometimes to take positions as other firms, start their own firm, leave the practice entirely, retire, or…gulp, die, disappear or become disabled.  All of these occurrences implicate the “left behind” lawyers’ duties under Missouri Rule of Professional Conduct 4-1.1. Competence, 4-1.3. Diligence, 4-1.4. Communication, 4-1.5. Fees, 4-1.6. Confidentiality of Information, 4-1.8. Conflict of interest; current clients; specific rules, 4-1.9 & 4- 1.10. Duties & Conflict of Interest, Former Client & Imputation to Law Firm, 4-1.15. Safekeeping Property, 4-1.16. Declining or Terminating Representation, 4-5.1. Responsibilities of partners, managers and supervisory lawyers, 4-5.6 Restrictions on Right to Practice, 4-8.3. Reporting Professional Misconduct, and 4-8.4. Misconduct.  Attendees will learn how to identify where their potential ethics and malpractice risk lies, and the systems they need to have in place BEFORE they are “left behind.”

(Elimination of Bias) Hour 3 (50 minutes) - Imposter Syndrome in the Legal Profession - Legal professionals subject to imposter syndrome experience feelings of self-doubt and incompetence no matter what their education, experience, and professional accomplishments might be. For too long this Syndrome has been thought of as an individual, internal phenomenon.  However, increasingly this issue is understood as being strongly linked to broader socio-cultural contexts. This program will examine how historical biases in the legal profession, societal structures, and law firm customs contribute to its manifestation and perpetuation and identify steps individuals and organizations can take to positively address them.

(Ethics) Hour 2 (50 minutes) – The Ethics and Malpractice Risk When Lawyers Leave Law Firms – Lawyers leave law firms.  Sometimes to take positions as other firms, start their own firm, leave the practice entirely, retire, or…gulp, die, disappear or become disabled.  All of these occurrences implicate the duties of the “left behind” lawyer and the leaving lawyer under Kansas Rules of Professional Conduct.  Attendees will learn how to identify where their potential ethics and malpractice risk lies, and the systems they need to have in place BEFORE they are “left behind.”
(Elimination of Bias) Hour 1 (50 minutes) - The Ethics and Malpractice Risks of Cultural Incompetency & Bias
This program will include a comparison of Missouri Rule 4-8.4(g), Kansas Rule 8.4(c), (d) & (g)), and ABA Model Rule 8.4(g), their related COMMENTS and the implications for their differences, and an overview of general explicit or implicit bias, diversity, inclusion, or cultural competency awareness issues and resources.
(Ethics) (50 minutes) - Quantum Meruit, Lodestar, Rule 4-1.5 and Reasonable Fees
This program will discuss the unique and distinct features of Quantum Meruit and Lodestar calculations and the ethics and malpractice risks that can arise when proceeding for attorney’s’ fees under these different recovery models.  This program is for every lawyer who charges clients a fee.
(Ethics) (50 minutes) - The Malpractice Risks of the Most Frequent Ethics Complaints
This program will analyze the relationship between the most frequently reported violations of the Rules of Professional Conduct and law firm processes and procedures and the malpractice liability arising from the relationship between them.
