2023 Three Hour Program
The Ethics and Malpractice Risk of "Zealous Representation"
Approved in Missouri for 3.0 Ethics hours including 1.0 hour Elimination of Bias credit. Approved in Kansas for 3.0 Ethics and Professionalism hours.
Although the Missouri Rules of Professional Conduct only briefly mention "zealous representation", clients, courts, and disciplinary authorities still speak of it fondly and often expect and demand it. This program will look at the risks lawyers face when they cross the "zealous" line with clients, third-parties, other lawyers, courts, and yes, disciplinary authorities.
Course Schedule -
Hour One - The QUIZ - A potpourri of the hottest topics in legal malpractice and ethics, and what you need to know to protect yourself from novel malpractice risks and ethics complaints.
Hour Two - A look at Missouri Rules of Professional Conduct 4-1.3: Diligence, 4-3.1: Meritorious Claims and Contentions, 4-3.2: Expediting Litigation, 4-3.3: Candor Toward the Tribunal, 4-3.4: Duties to Opposing Party and Counsel and Ethical Obligation to Follow Court Orders and Rules, 4-3.5: Impartiality and Decorum of the Tribunal, 4-4.1: Truthfulness in Statements to Others, 4-4.4: Respect for Rights of Third Persons, and 4-8.4: Misconduct, and how these Rules constrain lawyers' professional and personal conduct.
Hour Three - Elimination of Bias and The Ethics and Malpractice Risk of "Zealous Representation", with a look and forms of implicit bias and how the application of mindfulness techniques in everyday situations can help us act on our values.

This program will review ethics opinions and malpractice decisions from around the country and discuss what you need to do to protect yourself, your practice and your clients. Included will be a discussion of Conflicts of Interest, Responding to negative online reviews, Settlement talks and Rule 4-8.4, Crowdfunding and Rule 4-1.0(e), Reasonable Attorney Fees under fee shifting statutes, the ethics of Trust Account Cyber Scams, and more.
